THE LEGAL REGIME OF THE CASPIAN SEA IN SUPPORT OF THE REGIONAL SECURITY ISSUE

The issue of the international legal status of the Caspian Sea is a key problem not only in terms of compliance with the material contents of the United Nations Convention on the Law of the Sea but also for the impact on the practical cooperation among the littoral states, based on a rational and efficient use of the resources located therein. The 'mixed condominium' approach is under debate in order to demonstrate that the legal regime in force on this case is a peculiar one by the regional point of view, according to shared and circumstanced needs of the littoral states.

Il tema dello status giuridico internazionale del Mar Caspio è un problema di tutto rilievo, non soltanto in una dimensione prettamente giuridica (vedi la conformità con il dettato della Convenzione delle Nazioni Unite sul diritto del mare) ma anche in ordine all'impatto cooperativo che ne discende sugli Stati rivieraschi, basato su un utilizzo razionale ed efficiente delle risorse che vi sono contenute. Il contributo si focalizza sull'approccio del c.d. 'condominio misto', al fine di dimostrare che la sua applicazione al caso di specie è particolare nel suo rilievo regionale, in relazione alle esigenze proprie dei rivieraschi.
