The article suggests that the European response to the issues of anonymous speech on the Internet is and should be different from the US one and should vary on the basis of a series of factors such as: – Who is communicating; – With whom they are communicating; – ‘Where’ they are communicating; – What is being communicated; – What are the competing interests; The article concludes with some indications on the role gatekeepers and bona fide proxies should have and on the applicable law.
