The author focuses on certain aspects of the role of the President of the Republic in relation to the State of Emergency. After presenting the regulation of the State of Emergency and the President's powers in that area, he concludes that the said regulation is often indeterminate. He furnishes some examples – beginning with the very notion of »State of Emergency« – in order to show why this is a problem. In the central part of the text he presents three possible interpretations of the powers of the President in a State of Emergency, and supports the one he considers to be the most balanced insofar as the principles of efficiency, independency and responsibility (of the President) are concerned. Finally, he addresses the issue of President's responsibility for acts commited during the State of Emergency.

Abstract
The author focuses on certain aspects of the role of the President of the Republic in relation to the State of Emergency. After presenting the regulation of the State of Emergency and the President's powers in that area, he concludes that the said regulation is often indeterminate. He furnishes some examples – beginning with the very notion of »State of Emergency« – in order to show why this is a problem. In the central part of the text he presents three possible interpretations of the powers of the President in a State of Emergency, and supports the one he considers to be the most balanced insofar as the principles of efficiency, independency and responsibility (of the President) are concerned. Finally, he addresses the issue of President's responsibility for acts commited during the State of Emergency.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
