This paper reflects upon the current UNSC’s smart sanctions practice with the aim to unravel novel legal problems arising from the interaction between sanctions, normative regimes and institutions. As to normative interactions, it points out that processes of individualization and formalization are transforming sanctions regimes from preventive measures to tools of human rights/international humanitarian law/international criminal law enforcement, thereby subverting how article 41 of the UN Charter should operate. As to institutional interactions, this paper discusses the negative effects of sanctions on humanitarian assistance. This is mainly caused by poor resolution drafting, regimes fragmentation and diverging implementing practices. It concludes that in the years ahead the UNSC should take normative and institutional interactions seriously when designing sanctions regimes.
