Legal perspectives on the streaming industry and online copyright infringement in Italy

This contribution aims at providing an overview of the relevant legal issues affecting online streaming activities, mainly concerning copyright law and liability, in the Italian context. First it provides an overview of the most relevant provisions in force and focuses on the double track enforcement system in place for online copyright infringement and on the important role played by the Italian Communications Regulatory Authority (AGCOM). Then, it analyses the latest and most relevant case law concerning the liability of internet service providers and finally considers the national implementation of the recent European measures applicable in this area, i.e. the 2019 Copyright Directive and the revised audiovisual media services Directive (AVMSD).
