The contribution examines the apprenticeship contract in the multilevel regulatory framework between state, regional competence and collective autonomy, with in-depth analysis relating to the field of application, legal limits and quota ceilings. The author analyzes the elements relating to the regulation of the relationship, the working hours, the possibility of accumulating multiple apprenticeship contracts, the remuneration paid to the apprentice and the issues relating to the termination of the relationship. A particular focus is placed on the training component of the contract, on the role of the tutor and on regulatory incentives and social security contributions and tax relief. The contribution concludes with an examination of the sanctioning system between violation of the general principles, failure to fulfill the training obligation and burden of proof.
Il contributo esamina il contratto di apprendistato nel quadro regolatorio multilivello tra competenza statale, regionale e autonomia collettiva, con approfondimenti relativi al campo di applicazione, ai limiti legali ed i tetti di contingentamento. L'autrice analizza gli elementi relativi alla disciplina del rapporto, l’orario di lavoro, la possibilità di cumulo di più contratti di apprendistato, la retribuzione riconosciuta all’apprendista e le questioni attinenti alla cessazione del rapporto. Un particolare focus viene svolto sulla componente formativa del contratto, sul ruolo del tutor e sulle incentivazioni normative e gli sgravi contributivi e fiscali. Il contributo si conclude con la disamina dell'apparato sanzionatorio tra violazione dei principi generali, inadempimento dell’obbligo formativo e onere della prova.
