This contribution aims at providing an overview of the relevant legal issues affecting online streaming activities, mainly concerning copyright law and liability, in the Italian context. This paper is structured as follows. First, it provides an overview of the most relevant provisions in force in Italy. Second, it examines the ‘double track’ enforcement system for online copyright infringement and the important role played by the Italian Authority for Communications (AGCOM). Next, it analyses the latest and most significant case law concerning the liability of internet service providers. Finally, the paper considers the national implementation of the recent European measures in this area, i.e. the CDSM Directive and the revised audiovisual media services Directive (AVMSD).
