IL REGIME NORMATIVO DEGLI INTERNET SERVICE PROVIDER E LA TUTELA DEI DIRITTI COSTITUZIONALI IN RETE

The doctoral thesis analyzes the evolution of the relationship between law and technology, with a particular focus on the role of Internet Service Providers (ISPs) and constitutional rights. It examines the adequacy of both EU and national legal frameworks — from the E-Commerce Directive to the Digital Services Act — exploring their foundations and proposing an evolutionary reinterpretation of fundamental rights in the context of information society services

L'elaborato analizza l'evoluzione del rapporto tra diritto e tecnologia, con particolare attenzione al ruolo degli Internet Service Provider (ISP) nella tutela dei diritti costituzionali in rete. Esamina l'adeguatezza del quadro normativo unionale e nazionale, a partire dalla Direttiva E-Commerce al Digital Services Act, indagandone le fondamenta costituzionali e proponendo una rilettura evolutiva dei diritti fondamentali alla luce della società dell’informazione.
