The paper focuses on the essential levels of environmental technical performance (so-called LEPTA), which – as they fall within the Essential Levels of Performance whose determination belongs to the exclusive legislation of the State pursuant to art. 117, paragraph 2, letter m, of the Italian Constitution – must be guaranteed uniformly throughout the national territory. After having reconstructed the legislation that provided for them and the constitutional jurisprudence on the matter, we will ask ourselves what their function is and the subjects who must proceed with their implementation. The impact of the essential levels of environmental technical performance will then be analysed also in the light of the National Recovery and Resilience Plan.
