Starting from a passage of Ulpian concerning the remissio of a certum given as freight payment, this study aims to highlight, on the one hand, how the modalities of freight compensation may illuminate the reconstruction of the parties’ intent, which underpins the lex contractus; and, on the other, how the interest of mercatores-caricatores in long-distance trade found a strong incentive in the availability of contractual and procedural instruments capable of allocating the periculum navigationis to the carrier.
