Digitisation opens up new versions of the traditional categories of “work”, “author” and “creativity”. In particular, the Artificial Intelligence (AI) raises the delicate question of the author’s protection, on one hand of the direct “input” to the traning of machines and, on the other hand, of the “output” generated by the algorithm, as evidenced by the rich national and international case studies examined. The tendency to identify “a predominant human contribution” at the basis of the work created through the AI, in order to attribute the author’s protection, has led someone to conceive the notion of author in a “evolutionary” sense, detached from the human person, and others, on the other hand, to put more emphasis on the paradigm of the “neighboring rights” that belong to the licensee of an AI system. In the opinion of the author, it would be rather desirable, in a preventive view of the dispute, an authorial protection by design in digital environment, valuing therefore the “digital self-protection”, but at the same time containing its risks, through the careful balancing process between the protection of individual rights and access to content which presides over the modern “digital democracy”.
La digitalizzazione apre a nuove declinazioni delle tradizionali categorie di “opera”, “autore” e “creatività”. In particolare, l’Intelligenza Artificiale pone la delicata questione della tutela autoriale, per un verso, dell’input diretto al traning delle macchine e, per altro verso, dell’output generato dall’algoritmo, come attesta la ricca casistica nazionale e internazionale esaminata. La tendenza ad individuare “un apporto umano prevalente” alla base dell’opera creata attraverso l’AI, al fine di attribuirvi la tutela autoriale, ha indotto taluni a concepire la nozione di autore in senso “evolutivo”, sganciato dalla persona umana in quanto tale, ed altri, invece, a porre piuttosto l’accento sul paradigma dei c.dd. diritti connessi in capo al licenziatario di un sistema di AI. A parere dell’autore, sarebbe piuttosto auspicabile, in ottica preventiva della lite, una tutela autoriale by design in ambiente digitale, valorizzando dunque la c.d. “autotutela digitale”, ma, al contempo contenendone i rischi, nell’accorto processo di bilanciamento tra la protezione dei diritti individuali e l’accesso ai contenuti che presiede la moderna “democrazia digitale”.
