Patent pledges are voluntary commitments by patent holders to waive some or all exclusive rights linked to one or more patents. In this way, patent pledges become privileged tools for the diffusion of knowledge, performing a particularly useful function in the field of green innovation, by virtue of the complementary nature and fragmentation of the related patents. Starting from some contributions in legal literature on the configurability of obligations connected to patent pledges, this work intends to propose a comparison between the United States and Germany. In particular, the research considers the private law instruments that the two systems propose to bind patent holders who make patent pledges. This reflection can encourage collaboration and the transfer of green technologies.

Abstract
Patent pledges are voluntary commitments by patent holders to waive some or all exclusive rights linked to one or more patents. In this way, patent pledges become privileged tools for the diffusion of knowledge, performing a particularly useful function in the field of green innovation, by virtue of the complementary nature and fragmentation of the related patents. Starting from some contributions in legal literature on the configurability of obligations connected to patent pledges, this work intends to propose a comparison between the United States and Germany. In particular, the research considers the private law instruments that the two systems propose to bind patent holders who make patent pledges. This reflection can encourage collaboration and the transfer of green technologies.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
