Questo articolo sviluppa una duplice analisi. Da una parte, analizza gli ostacoli che le pubbliche amministrazioni nazionali pongono alla corretta ed effettiva integrazione del mercato europeo, quando violano il diritto comunitario nelle loro decisioni. Secondariamente, l'articolo si focalizza sulla rete SOLVIT, che fornisce un'alternativa alle Corti nazionali nella protezione dei cittadini e delle imprese che subiscono pregiudizio a causa di siffatte decisioni illegittime. In particolare, viene analizzata la struttura di SOLVIT come "rete di cooperazione", la sua attività, nonchè il relativo rapporto con la Commissione europea e l'Ombudsman europeo. Nella parte finale, si tracciano poi delle conclusioni, relative all'efficacia del meccanismo.

Abstract

First of all, it discusses the threat that national administrations pose to the integration of the internal market when they infringe EU law in individual decisions. Secondly, it focuses on the SOLVIT network, which provides an alternative to national Courts in protecting the citizens and undertakings that are adversely affected by those infringements.
