The paper is a commentary on the sentence n. 20644/2004 of the Supreme Court of Cassation. The paper deals with three different problems concerning limits on testamentary freedom: a) the 'dies a quo' of the prescription term of the reduction action; b) the invalidity for heir preterition of the testamentary partition; c)the testamentary disposition of the inheritance usufruct to the surviving spouse with 'ex asse' disposition to the sons.
