The free convey of food to avoid the waste of food To avoid wasting the law of August 16, 2016, no. 166 provided for Italian companies the free supply of food for the benefit of the poor people. The essay analyzes some critical points of the law and, above all, the difficulties of exact legal qualification of the supply of food. There are many differences from the definition of donation of the Italian Civil Code that make it impossible to apply the provisions of the Civil Code to the convey of foodstuffs. The author examines the problems of food waste in Europe and criticizes the solution of the French law punishing companies who do not comply with the obligation to transfer non-sold foods against waste instead of giving incentives to virtuous behaviors.
