Unlike the constitutional experience of the United Kingdom, on the European continent the presence of a weak and fragmented party system has been - and still is - the main cause of the fragility of institutions parliamentarians. Moreover, the presence of anti-constitutional political forces worsened the unstable situation. However, only part of the Italian and French doctrine, mostly influenced by the experience of British and American political parties, in the nineteenth century highlighted the centrality of this problem for the proper functioning of the parliamentary system. This led to the propose of legal recognition for political parties.
