La Corte costituzionale è chiamata a pronunciarsi sull’eventuale sussistenza del diritto a morire (Osservazioni a margine dell’ordinanza della 1^ Corte di Assiste di Milano, 14 febbraio 2018, imp. Cappato)

This work analyzes the judgements of Milan’s court of assizes about the application of article 580 of Penal Code, which penalizes the assistance to suicide. The judge believes that a “right to die” exists in Italy, on the basis of some constitutional principles, like as the right to refuse medical treatments or the principle of self-determination, and on the basis of European Court of Human Rights’ jurisprudence. According to this point of view, the art. 580 of Penal Code should not comply with Constitution. So, he decided to raise the question of constitutionality. However, this work tries to answer the following question: does “right to die” truly exist according to Italian constitutional system?
