La camera di consiglio aperta agli esperti nel processo costituzionale: un’innovazione importante in attesa della prassi

This paper deals with the change of the Internal Regulations of the Constitutional Court which allow to experts to be heard in the council chamber, during the constitutional proceedings. This essay will focus on five aspects of this change: the subjective qualification of experts; the proceedings’ phase during which the council chamber is open to the experts; the guarantee that the parties will also be heard in this “new” phase of the proceedings; the relationship with the participation of the amici curiae; the difficult interrelation between the hearing of the experts and the investigative powers of the Court. Many solutions to these problematic aspects will be provided by the future praxis of the Constitutional Court. However, it is possible to underline both the positive aspects of this new insitution and the critical ones.
