The paper aims at analyzing the principle of proportionality throughout the regulation of criminal sanctions. Through a philosophical and historical method, the basic elements of the proportionality of the sanction will be traced and its structure in Criminal Law will be defined. The analysis will be pointed at collecting the existing doctrine about the mentioned topic and the Constitutional Case-Law thereon.
