Through the various forms of ‘societies’ individualized in the Roman world emerges the one corrispondingto the contract of societas. The charatheristic of the latter is to have as a genetic element the consensusof its members (socii). Through an analisys that extends from the oldest associated form represented by the consortium ercto non citoand by the consideration of the greek reflection on the fundamental basis of the political society, the writing wants to grasp the possible cultural roots which have brought Roman juridical science to individualize the consensusas a fundamental base of the contract of societas.
