The paper is the result of a preliminary work, being part of a broader research on the topic of imprisonment in Rome in the first half of the nineteenth century. The first chapter analyzes the reasons for the birth of the penitentiary and focuses on the main themes of the Prison Reformers’ debate during the XIX century. In the second chapter the main (French, Anglo-Saxon and Italian) doctrinaire works on the subject are reported, by extrapolating the historiographic themes and comparing them with each other. Finally, the third chapter is dedicated to Rome and the Papal States. The peculiarities of that criminal order are underlined and the current state-of-the-art of research on the topic is traced.
