L'educazione della prole tra antiche prerogative genitoriali e nuovo interesse del minore

The education of children, which is one of the rights and duties of parents, and now a right of the child, must be reconsidered in the light of the major changes in family law: the transition to the parental responsibility, the new role assumed by the best interest of the child and by the respect for his identity still being formed. The content of this task is not neutral but must be anchored to a core of values essential for the development of the person and for his integration into society that is the ultimate goal of education itself.

L’educazione della prole, che rientra tra i diritti e i doveri dei genitori, ed è divenuto un diritto del figlio, va riconsiderata alla luce delle diverse mutazioni registrabili nel diritto di famiglia: dal passaggio dalla potestà alla responsabilità genitoriale al nuovo rilievo assunto dal superiore interesse del minore e dal rispetto della sua identità in formazione. Il contenuto di tale compito non è neutro ma deve ancorarsi ad un nucleo di valori essenziali per lo sviluppo della persona e per il suo inserimento nella società che è poi il fine ultimo dell’educazione stessa.
