FENOMENI MIGRATORI, RISCHIO SANITARIO E INSULARITÀ: L’USO POLITICO DELLE ORDINANZE CONTINGIBILI E URGENTI (CONSIDERAZIONI A MARGINE DELL’ORDINANZA N. 33 DEL 22 AGOSTO 2020 DEL PRESIDENTE DELLA REGIONE SICILIA)

Abstract (It.): l’articolo ricostruisce i confini del potere di ordinanza regionale al fine di esaminare l’ordinanza n. 33/2020, emanata dal Presidente della Regione Sicilia e successivamente annullata dal Tar Catania. L’atto, in particolare, muovendo dal presupposto di disporre misure di contrasto all’immigrazione clandestina, utilizzava il pretesto della crisi sanitaria per ordinare illegittimamente lo sgombero degli hotspot e dei centri di accoglienza dei migranti, facendo pensare a un uso “politico” delle ordinanze contingibili e urgenti. Abstract (En.): the essay analyzes the limits to the competences of regional decrees in order to examine the decree n. 33/2020, issued by the President of the Region of Sicily, and subsequently invalidated by the Catania Regional Administrative Court. The act, in particular, with the purpose of ordering measures to tackle illegal migration, invoked the pretext of the ongoing health crisis to unlawfully command the clearance of hotspots and reception centres for migrants, thus suggesting a “political” use of the so called «ordinanze contingibili e urgenti».
