The paper aims to comment the judgement no. 48/2021 of the Italian Constitutional Court. The decision has rejected the questions raised by the Tribunal of Rome about the provisions of the electoral law on the presentation of lists and candidates; however, for the first time these questions have been admitted, in order to ensure that the right to candidacy can be protected by ordinary judges when it seems to be infringed by some rules or by some pre-election acts (since in Italy specific procedural rules for pre-vote disputes on passive electorate related to political elections do not exist yet). This contribution proposes some reflections on these subjects, enlightening some objective problems caused by rules for collecting signatures in support of lists: only few parties (that formed two groups at the beginning of the current legislature) are exempted from this procedure, while it is very onerous and technologically outdated for the other parties.
