While the Italian legal system notoriously belongs to the family of ‘civil law’, over the last decade or so the Italian legal culture has been engaged in an intense debate over the issue of the creative import of legal interpretation, especially in the guise of judge-made law. The present essay tries to shed some light over the many different theoretical issues that are at stake in this debate, and to put interpretive creativity in its right place.
