Le misure dell'Unione europea per affrontare la sfida della sicurezza energetica: basi giuridiche e strumenti di attuazione

The exceptional emergency following the Russian invasion of Ukraine has made urgent to reformulate the European energy policy. The aim of this work is to analyse the instruments adopted by the European Union in the light of the relevant legal basis of the Treaty, considering them in the dual perspective of “reaction” to the emergency and “action” for realizing the objective of energy security in the medium and long term. While the latter are within the framework already outlined by European Climate and Energy Governance, the emergency measures seem to be affected by a “national dimension” that risks undermining the effectiveness of the responses to the current crisis. Although it is premature to arrive at conclusive con- siderations as to their effectiveness, it is important to stress the need to strengthen the “supranational dimension” of the instruments for implementing the objectives of energy security in the short and medium term, according to the legal basis of the EU Treaty and the case law of the Court of Justice.
