The aim of this paper is to reconsider anticorruption from a regulatory perspective. In fact, while regulation used to be considered the first and most powerful tool for combating and preventing corruption, paradoxically, laws and regulations provide opportunities for rent -seeking and can be frequently used as tools for profit. When a regulation establishes administrative activities and controls, for example, it makes public agents more vulnerable to bribery or other illicit exchanges. This approach requires an integrated regulatory anticorruption strategy –enriched by contributions from behavioral sciences – that combines different tools. Such a strategy would involve better regulation tools, such as simplification as well as ex ante and ex post assessment of legislation and regulation; transparency about the interests affected by legislatio n and involved in the process of making law; assessment of regulation for potential corruption; anticorruption management of existing stock of regulations

E l objetivo del presente trabajo es reconsiderar la lucha contra la corrupción desde una perspectiva regulatoria . De hecho, aunque la regulación solía considerarse la primera y más poderosa herramienta para combatir y prevenir la corrupción, paradójicamente, las leyes y los reglamentos ofrecen oportunidades para la búsqueda de rentas y pueden utilizarse como herramientas para obtener beneficios. Cuando una normativa establece actividades y controles administrativos, por ejemplo, hace a los agentes públicos más vulnerables al soborno u otros intercambios ilícitos. Este enfoque requiere una estrategia reguladora anticorrupción integrada –enriquecida por las aportaciones de las ciencias del comportamiento– que combine diferentes herramientas. Dicha estrategia implicaría una mej oría de la regulación, como la simplificación y la evaluación ex ante y ex post de la legislación y la regulación; la transparencia sobre los intereses afectados por la legislación e implicados en el proceso de elaboración de la ley; la evaluación de la regulación para detectar posibles casos de corrupción; la gestión anticorrupción de la normativa existente.
