La standardizzazione contrattuale può produrre effetti anticoncorrenziali e la verifica va operata in concreto impiegando criteri che non sempre consentono un apprezzamento chiaro e certo della reale consistenza delle situazioni considerate. Nella vicenda delle fideiussioni omnibus ci si è interrogati sulla sorte dei contratti a valle dell’intesa anticoncorrenziale a monte e Cass., Sez. Un., 30 dicembre 2021, n. 41994 ha ritenuto la nullità parziale il rimedio più adeguato; ciò nonostante, il panorama della tutela si presenta aperto ad altre soluzioni ed il rapporto tra tutela demolitoria e risarcitoria è connotato da instabilità, tra interferenza, complementarietà e, in un certo qual modo, intercambiabilità.
