The Author deals with an interesting decision adopted by Public Prosecutor Office to the Italian Supreme Court, regarding the rule provided by article 412 of the Italian Code of Criminal Procedure. She emphasizes that the ex- amined decision could be considered as a landmark into the long-standing debate concerning the requirements provided by article 412 of the Italian Code of Criminal Procedure, showing a clear preference for one of the two doctrines outlined by the law science.
