Two recent Orders of the First Section of the Supreme Court have reduced the general impeding relevance of cohabitation between spouses lasting for over three years after the celebration, in the exequatur of ecclesiastical sentences of matrimonial nullity (Cass. sez. un. 2014). For the First Section, the limit would apply only to canonical marital defects that do not present «objective characteristics at least similar» to those of the civil code. First Section speaks of a more correct exegesis than the 2014 «Twin Judgments»; in our opinion, however, the First Section would have established a new and different principle. This revirement would have made it necessary to be referred to the United Sections.
