The article aims to systematically identify, analyze and reconstruct the main changes made by the transposition of the Circular Economy package to Legislative Decree no. 152/2006 (IEC). Six changes in the waste part of the Italian Environmental Code (IEC) that expressly mention the Circular Economy are identified and the shift from the concept of collection to that of recycling is discussed. The links to the Circular Economy of both the national waste prevention program and organic waste management program are then highlighted. The new features introduced by the Circular Economy Package with reference to Extended Producer Responsibility systems (EPR schemes) are then analyzed, and in particular the relationship between the principle of Competition and the functioning of these systems as instruments for protectingthe environment. The article points out the notion of waste collection systems as real infrastructures that must guarantee equal access to the various EPR schemes and regulatory model of such a system highlighting the role of ARERA (Italian Regulatory Authority for Energy, Networks and Environment) in this regard. It concludes by arguing that the entire fourth part of the Italian Environonmental Code should be rewritten as the approach has radically changed in a "circular" sense.
L’articolo si propone di individuare, analizzare e ricostruire sistematicamente le principali novità apportate dal recepimento del pacchetto sull’economia circolare al d.lgs. n. 152/2006 (TUA). Si individuano sei modifiche della parte relativa ai rifiuti che citano espressamente l’economia circolare e ci si sofferma sul passaggio dal concetto di raccolta a quello di riciclaggio. Si evidenziano poi i collegamenti con l’economia circolare sia del programma nazionale di prevenzione dei rifiuti che della gestione dei rifiuti organici. Si analizzano poi le novità introdotte dal pacchetto sull’economia circolare con riferimento ai sistemi di Extended Producer Responsibility (sistemi di EPR) e in particolare i rapporti tra il principio di concorrenza e il funzionamento di tali sistemi come strumenti di tutela dell’ambiente. Ci si sofferma sulla nozione dei sistemi di raccolta dei rifiuti come vere e proprie infrastrutture che devono garantire parità di accesso ai vari sistemi di EPR e sul modello di regolazione di tale sistema evidenziando il ruolo di ARERA al riguardo. Si conclude sostenendo che l’intera parte quarta del TUA andrebbe riscritta essendo cambiato radicalmente l’approccio in senso “circolare”.
