With the introduction of paragraph 7 in art. 33 of the Constitution, the legislator introduced a direct and explicit reference to sporting activity at the constitutional level, going beyond the simple delimitation of sport as a matter of concurrent legislative competence. In this way, sport was recognized as a factor of integration (social, spiritual and cultural), evoking a predominantly anthropocentric conception of the same "right to sport", as autonomous and not mere corollary or substitute for other individual rights. A hermeneutic reading of sporting activity emerges both as a value in itself and as a vehicle of values, as a tool for social inclusion and the promotion of the full development of the human person, with particular regard to his psycho-physical well-being, encouraging access to it. With the entry into force of the new Article 33 of the Italian Constitution, a conception of access to sporting activity as a subjective claim of the citizen towards "La Repubblica" makes its way into the work of the interpreter. A novelty for the Italian legal system that finds similar precedents in other European Constitutions and qualified confirmation at the supranational level, especially with reference to children.
Con l’introduzione del comma 7 nell’art. 33 Cost., il legislatore ha inserito a livello costituzionale un riferimento diretto ed esplicito all’attività sportiva, andando oltre la semplice delimitazione dello sport quale materia di competenza legislativa concorrente. In tal modo si è avuto un riconoscimento del fenomeno sportivo quale fattore di integrazione (sociale, spirituale e culturale), evocando una concezione prevalentemente antropocentrica dello stesso “diritto allo sport”, autonomo e non mero corollario oppure succedaneo di altri diritti individuali. Emerge una lettura ermeneutica dell’attività sportiva sia come valore in sé, sia come veicolo di valori, quale strumento di inclusione sociale e di promozione del pieno sviluppo della persona umana, con particolare riguardo al suo benessere psico-fisico, incentivandone l’accesso. Con l’entrata in vigore del nuovo art. 33 Cost. si fa strada nell’opera dell’interprete una concezione dell’accesso all’attività sportiva come pretesa del cittadino verso “La “Repubblica”. Una novità per l’ordinamento italiano che trova analoghi precedenti in altre Costituzioni europee e conferma qualificata a livello sovranazionale, specialmente con riferimento ai minori.
