Libertà di coscienza e giuramento nelle società plurireligiose europee. Approdi normativi, orientamenti giurisprudenziali e prospettive interculturali

The essay addresses the complex relationship between freedom of conscience and oath in a European legal space that is increasingly diversified in the religious and cultural fields. It focuses, in particular, on two distinct problems: the religiosity of the oath form and the structure of the oath, examining them both in relation with the freedom of conscience (art. 9 ECHR). The aim of the work is to identify the reasons underlying the tensions between the religious form of oath, structure of oath and freedom of conscience, proposing lines of research and possible solutions from both of plurireligious and intercultural perspective.

Il saggio affronta il complesso rapporto tra libertà di coscienza e giuramento in uno spazio giuridico europeo sempre più diversificato nel campo religioso e culturale. Esso si occupa, in particolare, di due distinti problemi: la religiosità della formula di giuramento e la struttura del giuramento, ponendoli entrambi in relazione alla libertà di coscienza (art. 9 CEDU). Lo scopo del lavoro è individuare le ragioni alla base delle tensioni tra formula religiosa del giuramento, struttura del giuramento e libertà di coscienza, proponendo linee di ricerca e possibili soluzioni in ottica sia plurireligiosa che interculturale.
