Daspo urbano: uno sguardo sulle questioni giuridiche controverse e un’indagine empirica

Using the socio-cultural notions of 'urban decency' and 'public safety', political decisionmakers have introduced measures into the legal system that, based on dangerousness, limit the fundamental rights, especially of subjects perceived as marginal and problematic for public order. The article presents the results of empirical research on the application of a legal institution that was introduced into our legal system at the end of the 1980s. The analysis of the data on the application of the legislation has made it possible to reconstruct the ideal-type of the 'asboed' subject. These are those individual profiles who live on the margins of our metropolises (homeless people, beggars, prostitutes, window-washers, street vendors, illegal parkers), both Italians and foreigners, who have in common the fact that they are less able to escape the control processes of the police apparatuses controlling the urban territory.
