The contribution focuses on the practical implications of the reform on disability matters, as introduced by Legislative Decree No. 62/2024, highlighting the need of an effective coordination between the new regulatory framework—centered on the individualized life project and the multidimensional assessment of disability—and the preexisting procedural architecture of Law No. 68/1999 concerning targeted employment placement for people with disabilities. The author points out how the adoption of the bio-psycho-social model, instead of the the traditional medical-assistance approach, has led to a paradigmatic shift in the assessment of disability and in the modalities of work inclusion, a shift that is not yet fully integrated within administrative procedures and the mechanisms for accessing placement instruments. The essay emphasizes the urgency of harmonizing procedures between the new instruments introduced by Legislative Decree No. 62/2024 and Law No. 68/1999, by accelerating the adoption of implementing regulations and enhancing the involvement of social partners, with the aim of ensuring the effective work inclusion of persons with disabilities.
Il contributo si concentra sulle ricadute applicative della riforma in materia di disabilità, d.lgs. 62/2024, rilevando la necessità di un efficace raccordo tra la nuova disciplina, orientata al progetto di vita individualizzato e alla valutazione multidimensionale della condizione di disabilità, e la preesistente architettura procedurale della legge 68/1999 in materia di collocamento mirato delle persone con disabilità. L’ A. sottolinea come l’adozione del modello bio-psico-sociale – in luogo del tradizionale approccio medico-assistenziale – abbia comportato un mutamento paradigmatico nell’accertamento della disabilità e nelle modalità di inclusione lavorativa, non ancora pienamente integrato nei percorsi amministrativi e nei meccanismi di accesso agli strumenti di collocamento mirato. Il saggio evidenzia l’urgenza di armonizzare le procedure dei nuovi strumenti previsti dal d.lgs. 62/2024 e quelli preesistenti della legge 68/1999, accelerando l’adozione dei regolamenti attuativi e valorizzando la partecipazione delle parti sociali, allo scopo di garantire un’effettiva inclusione lavorativa delle persone con disabilità.
