The constitutional provisions and the law on the prison system establish the need to guarantee the right to health of incarcerated individuals, on equal terms with free individuals. This paper highlights the critical issues in the implementation of this right, identifying several alarming phenomena that must be considered both causes and symptoms of the failure of a constitutionally compliant model of penal execution. These include the condition of inmates suffering from psychiatric disorders and the general state of prison overcrowding. The hope is that prompt action will be taken—also through the financial resources currently available—to address these issues and to ensure adequate public healthcare for anyone deprived of their personal liberty, including within the administrative detention system.
