This paper, a revised and expanded version of the lecture delivered by the Author in Poznań on 17 September 2025 during the ARISTEC Seminar “Formal promise – Con-tract – Smart Contracts. Continuity and Changes in the Civilian Tradition”, explores the extent to which contractual types could be adapted to the parties’ intentions in Roman law. Focusing on third-century jurisprudence, it highlights Ulpian’s use of the expression «naturaliter inesse» as a key to understanding both the flexibility of the actio empti and the gradual layering of leges privatae within a system constrained by Typenzwang, which ultimately shaped the mature form of consensual sale.
