L’emergenza pandemica e il thema dell’informazione: i suoi principi ispiratori nel Piano pandemico nazionale

This paper aims to analyze the role that information, as a fundamental right, should play within the framework assigned to it in the “Strategic Operational Plan for Preparedness and Response to a Pandemic Caused by Respiratory Pathogens with High Pandemic Potential 2025-2029”. Starting from considerations relating to the past Covid-19 pandemic, characterized by exceptional circumstances followed by emergency measures, accompanied by information that was initially lacking and subsequently often excessive, conflicting, or incorrect, the provisions of the “Pandemic Plan” were analyzed, which, for the future, highlighted the need to convey «simple», «clear» and based on scientific evidence. The aim was therefore to verify, in addition to the current meaning assigned to Article 21 of the Constitution, what the correct balance between the management of a pandemic and the protection of the fundamental rights involved might be.

Il presente contributo si pone l’obiettivo di analizzare il ruolo che l’informazione, quale diritto fondamentale, dovrebbe svolgere nell’ambito del ruolo che gli è assegnato nel “Piano strategico operativo di preparazione e risposta ad una pandemia da patogeni a trasmissione respiratoria a maggiore potenziale pandemico 2025-2029”. Partendo da considerazioni relative alla passata pandemia da Covid-19, caratterizzata da un’eccezionalità a cui hanno fatto seguito misure emergenziali, corredate da informazioni inizialmente carenti e successivamente spesso sovrabbondanti, discordanti od errate, è stato quindi analizzato quanto previsto dal “Piano pandemico” che, pro futuro, ha evidenziato la necessità di veicolare informazioni «semplici», «chiare» e basate su evidenze scientifiche. Si è inteso quindi verificare, a margine dell’attuale significato assegnato all’art. 21 Cost., quale possa essere il corretto bilanciamento tra la gestione di una pandemia e la tutela dei diritti fondamentali coinvolti.
