This essay examines the transformation of the magistracy in the Italian states between the late eighteenth and nineteenth centuries. Starting from Carlo Dionisotti’s reflections on the Piedmontese judiciary, it analyses the transition from the magistracy of the Ancien Régime, politically autonomous and endowed with broad interpretative powers, to the bureaucratic and hierarchical judiciary shaped by the French Revolution and the Napoleonic system. The article highlights how nineteenth-century judicial systems resulted from a compromise between traditional institutions and modern principles of legal rationalization and state centralization.
