This essay reconstructs the ongoing regulatory transition within occupational health and safety, examining the interconnections between the State-Regions Agreement of 17 April 2025, Law No. 198 of 29 December 2025 (converting Decree-Law No. 159/2025), Directorial Decree No. 8/2026 on interprofessional funds, and Lombardy Regional Law No. 4/2026, in their systematic coordination with Legislative Decree No. 81/2008, the cornerstone of the Italian preventive framework. The analysis, conducted across normative, organisational, financial and technological dimensions, posits that the effectiveness of training necessitates the traceability of the learning pathway and the verifiability of its behavioural outcomes. This drives the shift from a merely formal employer liability to a substantive, results-based liability, centred upon “effective training” as a benchmark of the heightened standard of care, measurable through continuous monitoring. Finally, the contribution highlights emerging systemic challenges, such as the risk of regional fragmentation and the digital divide among micro-enterprises. As a forward-looking synthesis, it proposes the adoption of an integrated and interoperable national system that leverages recent technological trials; from this perspective, it evaluates the DWS (Digital Wallet for Safety) as an immutable cryptographic infrastructure capable of ensuring the traceability, interoperability, and evidential certainty of training events, thereby facilitating the portability of the worker’s competency profile and fostering labour mobility.
Il saggio ricostruisce la transizione ordinamentale in atto nella sicurezza sul lavoro esaminando le interconnessioni tra l'Accordo Stato Regioni 17 aprile 2025, la legge 29 dicembre 2025, n. 198 (conv. D.L. n. 159/2025), il Decreto Direttoriale n. 8/2026 sui fondi interprofessionali e la l.r. Lombardia n. 4/2026, nel loro coordinamento con il D.Lgs. n. 81/2008 quale norma cardine del sistema prevenzionistico italiano. L’analisi, condotta sulle dimensioni normativa, organizzativa, finanziaria e tecnologica, assume che l’effettività della formazione richieda tracciabilità del percorso e verificabilità degli effetti comportamentali, determinando il passaggio da una responsabilità datoriale formale a una responsabilità sostanziale di risultato, incentrata sulla “formazione efficace” come parametro di diligenza qualificata misurabile tramite monitoraggio continuo. Il contributo segnala, altresì, le criticità sistemiche emergenti, quali il rischio di frammentazione regionale e il digital divide delle piccole e medie imprese, e propone come sintesi prospettica l’adozione di un sistema nazionale integrato e interoperabile che valorizzi anche le recenti sperimentazioni tecnologiche; in tale prospettiva viene valutato il Digital Wallet for Safety (DWS) quale infrastruttura crittografica immutabile idonea a garantire tracciabilità, interoperabilità e certezza probatoria degli eventi formativi, anche in funzione della portabilità della biografia competenziale e della mobilità lavorativa.
