The Brescia Tribunal, by judgment of 14 April 2026, dismisses the claim brought by the worker seeking a declaration of unlawfulness of the open ended agency work arrangement. Proceeding from an analytical reconstruction of the relationship, the court accentuates the stability of the bond with the agency and the attendant safeguards (stand by allowance, subsequent redeployments), so as to exclude a condition of precariousness comparable to a fixed term employment relationship and to circumscribe, in applicative terms, the ambit of the “reasonable temporariness” requirement. The ruling thus stands as an interpretative paradigm of staff leasing, resisting the temptation to assimilate it to configurations of abuse of temporary agency work.
Il Tribunale di Brescia, con sentenza del 14 aprile 2026, ha rigettato la domanda del lavoratore volta a far dichiarare illegittima, per eccessiva durata, la somministrazione di lavoro a tempo indeterminato. Muovendo da un’analitica ricostruzione del rapporto, il giudice valorizza la stabilità del vincolo con l’agenzia e le garanzie connesse (indennità di disponibilità e successive ricollocazioni) per escludere una precarietà assimilabile al rapporto di lavoro termine e per circoscrivere, in chiave applicativa, la “ragionevole temporaneità”. La pronuncia offre un paradigma interpretativo dello staff leasing senza cedere alla tentazione di equipararlo a ipotesi di abuso del lavoro temporaneo.
