The essay examines the result of the Italian law (l. n. 193/2023) on the Cancer Oblivion within the European context, especially focusing on the impact of the «right of non-disclosure» on the contractual relationships (being formed or already established). The study adopts a remedial perspective as a privileged vantage point for the protection of the vulnerable individuals (cancer survivors), attempting to systematize the constitutive, invalidatory, and compensatory remedies, as well as underscoring the absolute relevance of the new trans-typical civil remedy of «non-usability of acquired secret informations», as distinct from the mere «prohibition of processing of personal data», within the whole framework of Italian-EU public policy.
