This essay aims to explore the role and legal treatment of women in the criminal justice system during the Napoleonic period in Rome. First, the essay provides a brief overview of the introduction of the French penal system in the Roman States. The paper then focuses on the criminal law doctrine developed under the Napoleonic Criminal Code in the Departments of Rome and Trasimeno. Finally, two criminal trials involving women will be analysed. The first trial was held in 1809 against a woman named Anna, accused of murder. The second proceeding, dealing with an infanticide case, was brought before the Imperial Court of Rome in 1812 against a woman named Maria Antonia.
