In the reconstruction proposed by Allara, datio in solutum differs from payment and assumes full autonomy with respect to the latter. Although it is not the solvens who considers the performance of the aliud as a substitute for performance, but it is the common will of the solvens and the creditor to want to attribute to the performance other than the one due the value of substitution of performance, that is equivalent of performance; there are cases in which no willful cooperation of the creditor is necessary for the performance, while, in other cases, this cooperation cannot be disregarded (the acceptance of the creditor being a waiver of the right to refuse the performance other than due). In the case of datio in solutum, indeed, the immediate purpose of the act is to perform a performance equivalent to performance due, while «the substitution of the new debt for the old, which derives from the act, is an effect of the act itself».

Abstract
In the case of datio in solutum, indeed, the immediate purpose of the act is to perform a performance equivalent to performance due, while «the substitution of the new debt for the old, which derives from the act, is an effect of the act itself».I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
