The article examines the judgment of the Court of Justice of the European Union in Case C-907/24, Egenergy, concerning the termination of the employment relationships of eight workers who had refused to relocate following the closure of their original workplace. The ruling provides an opportunity to revisit the EU-law concept of ‘redundancy’ under Directive 98/59/EC and to clarify when a termination formally resulting from a worker’s refusal to comply with an employer’s instruction should instead be attributed to the organisational decision constituting its underlying cause. The analysis distinguishes between the lawfulness of the relocation under Article 2103 of the Italian Civil Code, the worker’s obligation to comply with the employer’s instruction, and the classification of the termination for the purposes of the Directive. It also examines the relevance of the foreseeability of terminations and the preventive function of collective consultation. Finally, the article considers the implications of the judgment for the interpretation of Article 24 of Law No 223/1991 in conformity with EU law, particularly as regards the inclusion, in the relevant count, of terminations causally attributable to a reduction in, or restructuring of, the undertaking’s activities.
