This presentation introduces Retake Roma as a model of innovation resulting from Freedom of Assembly, starting from the historical development of the Right of Peaceable Assembly, also in an international perspective, comparing the US and Italian constitutional provisions. It begins with the Italian Constitution, recalling the Statuto Albertino and the 1948 Constitution, regarding the requirement of prior notice in Italy, and then looks elsewhere, including the US Constitution, in light of the Right to Peaceable Assembly.

Abstract

This presentation introduces Retake Roma as a model of innovation resulting from Freedom of Assembly, starting from the historical development of the Right of Peaceable Assembly, also in an international perspective, comparing the US and Italian constitutional provisions. It begins with the Italian Constitution, recalling the Statuto Albertino and the 1948 Constitution, regarding the requirement of prior notice in Italy, and then looks elsewhere, including the US Constitution, in light of the Right to Peaceable Assembly.
